# The Failures That Recur in Bakery & Patisserie Retail: Cakes & Desserts

Generic checklists tell a Bakery & Patisserie what to do. This page shows **how often each failure actually happens and what it costs**. The data comes from published primary sources: FDA inspection datasets, UK FSA enforcement, WRAP and ReFED waste studies, and peer-reviewed research. It is the evidence behind our [free cake, bakery and dessert checklist packs](/checklists/). We independently checked the key numbers on this page against their original sources before publishing. No number on this page is estimated or generated.

## The recurring failures, ranked by frequency times cost

| # | Failure & published frequency | Sources |
| --- | --- | --- |
| **#1** | **Chilled cases holding cakes and cream fillings above 5°C while the shop is open**
Restaurants failed to keep food cold enough (cold holding) in 62–80% of restaurants (FDA 2017–18). So did 70% of retail deli counters - the closest match to a chilled dessert case that inspectors have studied (FDA 2015–16). This rate has stayed about the same for 20+ years of inspection data. | [FDA Restaurants 2017–2018](https://www.fda.gov/media/169390/download)
[FDA Retail Delis 2015–2016](https://www.fda.gov/media/148247/download) |
| **#2** | **Expired or un-date-marked cakes and desserts still in the chilled case**
35–64% of restaurants failed to mark expiry dates correctly (FDA 2017–18). So did 52% of delis. UK enforcement: Asda was fined £410k over 62 out-of-date items. An independent store was fined £1,700+ over 14 items - including profiteroles - after one complaint. | [FDA Restaurants 2017–2018](https://www.fda.gov/media/169390/download)

| **#3** | **Making and ordering too much cake and bakery stock**
US grocery unsold rates: breads & bakery 3.6%, prepared foods 8.1% (ReFED 2024). UK hospitality wastes 15–18% of food served, compared with 0.44% in managed retail (WRAP). Making too much food alone causes 22% of foodservice waste. Wasted food is worth about twice the profit made on food sales. | [ReFED/WWF Pact Data Report 2025](https://refed.org/uploads/pact-data-report-2025-final.pdf)

| **#4** | **No plan for cutting prices (markdown) on short-dated cakes, or cutting prices too late**
One extra day of shelf life cuts waste 42.8% (ECR field study). Cutting prices (markdown or dynamic pricing) is the waste solution with the highest profit potential on record (ReFED). | [ECR Sell More, Waste Less](https://www.ecrloss.com/research/sell-more-waste-less/) |
| **#5** | **Chilled and frozen deliveries arriving above safe temperature, accepted unchecked**
Nearly 47% of 684 perishable items across 169 shipments arrived above 40°F - some at 75°F (Rutgers study). Across studies of keeping food cold from delivery to the counter (cold chain), 14–58% of recorded temperatures were higher than recommended. 12% of global food production is lost because food isn't kept cold enough from delivery to the counter (IIR). | [Food Safety News](https://www.foodsafetynews.com/2017/05/research-shows-food-safety-gaps-in-home-delivery-meal-kits/)

| **#6** | **Undeclared allergens - nuts, milk, egg and gluten in cakes and desserts**
49.2% of all US food recalls in 2023 were undeclared allergens, up 27% year over year. UK anaphylaxis registry top triggers - tree nuts 26%, milk 20%, egg 12% - match exactly what a cake and pastry counter sells. Typical recall cost is about $10M. | [Food Safety Magazine / US PIRG](https://www.food-safety.com/articles/9437-thanks-sesame-us-food-recalls-due-to-undeclared-allergens-skyrocketed-in-2023-causing-half-of-all-food-recalls)

| **#7** | **Improper cooling of in-house prepared desserts, custards and cream fillings**
59–69% of restaurants failed to cool food correctly, across four FDA inspection rounds covering 20 years. Custards, cheesecakes and cream fillings need a clear two-stage cooling check. | [FDA Restaurants 2017–2018](https://www.fda.gov/media/169390/download) |
